"- .....- <br />~ ,. . <br />-~ <br />, RESOLUTION NO. 1871 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VN-159 SU~CTTO CERTAIN CONDITIONS <br /> WHEREAS an application for variance entitled VN-159 has <br /> been made to the City and said application has been processed <br /> and reviewed by the Planning Commission at its meeting on <br /> August 17, 1976, and heard and considered by the Council at <br /> public hearings on September 28, 1976 and October 12, 1976, <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> VN-159: <br /> Findings of Fact <br /> 1. That there was filed with the City on August 13, 1976 an <br /> application, VN-159, for a variance to allow a 45 foot wide <br /> driveway on Silver Lake Road rather than the maximum <br /> 36 foot wide driveway permitted in Section 12-060 ( f) of the <br /> Zoning Coder <br /> 2. That said application was heard and reviewed by the Planning <br /> Commission at its meeting of August 17, 1976r <br /> 3. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing on September 28, 1976, to <br /> consider the applicatlon and continued such hearing to <br /> October 12, 1976. The applicant and other persons present <br /> at the hearings were given an opportunity to be heardr <br /> 4. The written comments and analysis of the City Planner, the <br /> Planning Commission minutes and recommendations and all <br /> person's statements made at the public hearings were <br /> considered including the statements of the applicant and <br /> members of the Council. <br /> BE IT FURTHER RESOLVED, That the application for VN-159 is <br /> hereby approved for the following reasons: <br /> 1. The need and reason for said variance is that the shopping <br /> center entrance is a use which has not previously been <br /> specifically considered legislativelyr <br /> 2. The variance provides no special privilege because of the <br /> consolidation of driveways serving the proposed shopping <br /> center and adjacent properties: <br /> 3. The variance does not act as a detriment but rather <br /> promotes the interests of the public health, safety and <br /> welfare. <br />
