' ~ <br />" RESOLUTION NO. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACTS AND APPROVING APPLICATION FOR <br /> NC-16 <br /> WHEREAS an application for a non-conforming use permit en- <br /> titled NC-16 has been made by Wayne F. Gonnella to resume use <br /> of the property and expand the building located at 1820 Old <br /> Highway 8, and <br /> WHEREAS the procedural history of the application is as ! <br /> follows: <br /> 1. That an application for NC-16 was filed with the City I <br /> on February 9, 1977 and was heard and reviewed by , <br /> ~ <br /> the Planning Commission at its meeting of Feb. 15, 1977; j <br /> 2. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on March 8, 1977 <br /> to consider the application. All persons present at <br /> the hearing were given an opportunity to be heard. <br /> 3. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendations, <br /> and all personsJ statements made at the public hearing <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to the <br /> application for NC-16: <br /> 1. The property is presently unused. <br /> 2. The applicant proposes using the former filling station <br /> after modificat;ion for John Deere consumer products <br /> sales and service. <br /> 3. The existing Type IV non-conformities.~dentified in the <br /> project included: <br /> a. Lack of concrete curbing <br /> b. Less than 30 foot front yard setback for canopy <br /> c. Off-street parking lot within the 30 foot front <br /> yard setback area <br /> d. Off-street parking within 15 feet of a street <br /> right-of-way I <br /> e. Insufficient front yard landscaping. <br /> 4. The applicantJs plan indicates that the Type IV non- <br /> conformities would be addressed as follows: <br /> a. Concrete curbing would be provided in all areas <br /> required <br /> b. The canopy or building while being enclosed would be cut ')a <br /> 9 feet so that the setback from the right-of-way <br /> would be approximately 22 feet, thereby reducing <br /> the extent of an existing non-conformity <br /> c. All vehicle parking would be set back a minimum of <br />
