Additional landscaping would be provided in the front <br /> yard <br />5. The applicant's plan indicates 29 parking spaces which exceed <br /> the minimum requirement of 22. <br />6. The 22 foot setback for the canopy, or building although less then <br />the required 30, is mitigated by the 50 foot right-of-way from <br /> Old Highway 8 to the applicant's property. Therefore, the <br /> building is approximately 72 feet from the shoulder of <br /> Old Highway 8. <br /> BE IT FURTHER RESOLVED, That the application for NC-16 is <br />hereby approved. <br /> BE IT FURTHER RESOLVED, That the approval of non-conforming <br />use permit is subject to the following conditions: <br />1 . Conformance with the site and landscape plan signed by the <br /> Director of Community Development and the applicant and <br /> dated 3/22/77. <br />2. Expansion of the building must oqnform with the Zoning Code <br /> regulations requiring at least a 30 foot rear yard setback. <br />3. That when., Old Highway No. 8 (County Road 77) is upgraded, <br /> the applicant shall negotiate with Ramsey County to extend <br /> the concrete curbing from the applicant's property to the <br /> curbing a long the road". In the event that Ramsey County <br /> refuses, or is unable, to extend the road curbing to meet <br /> the curbing on the applicant's property, the applicant shall <br /> extend his own curbing so as to meet the curbing along <br /> County Road 77. <br />4. That all parking spaces conform to the 30 foot setback I <br /> ! <br /> requirement and the landscaping be extended accordingly. I <br /> I <br />5. That the attached comments from the Soil Conservation District <br /> are made part of this resolution and the suggested erosion I <br /> control measures therein shall be applied during and after <br /> construction of the building expansion. <br />6. That the applicant shall grant an easement in recordable form <br /> which shall give the City of New Brighton the right to prevent <br /> any alteration to the contours of the ground and the vegetation <br /> on the slope on the western and southern portions of <br /> the site below the elevation of 910 feet above sea level. <br />7. No flashing or whirling devices or pendants or other attentio~ <br /> gathering devices shall be permitted. <br />
