That reduction of the apartment units, a Type II non- <br /> conformity, from 10 units to 7 units is highly desirable <br /> and consistent with the proposed comprehensive plan. <br /> 4. That the large road right-of-way creates a unique <br /> circumstance and undue hardship in the re-use of this <br /> property for this particular use. <br /> 5. That the proposal is consistent with the intent of the <br /> zoning code as the building is actually set back further <br /> from the paved portion of the street than would normally <br /> be expected. <br /> 6. That the non-conformities are being reduced to the <br /> greatest practical extent. <br /> BE IT FURTHER RESOLVED, that the application for NC-29 is <br />and hereby approved subject to the following conditions: <br /> 1. Conformance with site and landscape plans dated March 21, <br /> 1978, signed by the applicant and City Planner. <br /> 2. That the apartment units be reduced from 10 units to <br /> 7 units. <br /> 3.
