AN OFFENSIVE TRADES LICENSE <br />AND AFFIXING CERTAIN CONDITIONS OF OPERATION. <br /> <br />I, WHEREAS The City of New Brighton is responsible for the <br />general safety, health, welfare and well-being of its residents <br />I, and has established codes to aid in carrying out this responsibili y, <br />'I and <br /> <br />WHEREAS City Code Chapter 24 entitled Sewer Department Reg- <br />ulations and Chapter 15, Article VII, entitled Offensive Trades, <br />and Metropolitan Sewer Board Rules and Regulations for Control <br />Agency Standards all apply to the operation of the Mengelkoch Co. <br />as a rendering business, and <br /> <br />WHEREAS The City is aware and has been informed that certain <br />I deficienc,ies in the operation of the Mengelkoch Co. have occurred <br />in the past with respect to these codes, rules, regulations and <br />I standards, and <br /> <br />I WHEREAS, The deficiencies which previously existed in regard <br />to disposal of sewage have, in the past, affected the safety, <br />health, welfare and well-being of the City's residents in that <br />such deficiencies cause plugging of the sanitary sewer and lift <br />station, interference with sanitary sewer service to others, <br />dumping of raw sewage on the open ground, and emission of offensiv <br />odors in the neighborhood, and <br /> <br />I WHEREAS On January 23, 1979, stack emission tests, in complet <br />I conformance with American Society for Testing Materials Method <br />I D-1391-57, were performed on the emissions from the stack of the <br />Mengelkoch Company plant facilities at 119 14th Street NE and <br />I such tests indicated an average odor level of 42 odor units per <br />I cubic foot, which is below the limit of 150 odor units allowed <br />II by Minnesota Pollution Control Agency Regulation APC-9. Further, <br />, that the test indicated a total emission level of 840,000 odor <br />I units per minute which is within the limit of one million odor <br />I units per minute allowed by APC-9, and <br /> <br />WHEREAS A second emissiofistestwas performed on August 8, <br />1979 which indicated an average odor level of 37 odor units <br />per cubic foot and a total emission level of 820,000 odor units <br />per minute. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the Offensive Trades <br />License of the Mengelkoch Co. for the premises at 119 14th <br />Street NE be granted under the following conditions: <br /> <br />! 1. All doors and windows shall be kept closed during periods <br />I of operation so that all rendering plant air will be <br />processed through a scrubber or burned, except during <br />periods of loading and unloading when loading doors <br />I may be open but these periods shall be kept to a minimum. <br /> <br />I 2. The Mengelkoch Co. shall continue to perform all <br />I obligations required of it by its agreement with the <br />I City of New Brighton dated January 25, 1977, and as <br />I <br />I amended by a subsequent agreement dated December 12, <br />: 1978. <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />
