RESOLUTION N0.08-067 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />WHE AS, an application has been made by Steve Trueman on behalf o AT&T Mobility to allow <br />exec >lon of an 125' monopole cellular tower with an additional 10' lightning rod in the rear yard <br />of industrial property located at 1565 1" Avenue NW, and <br />WHE AS, the procedural history of the application is as follows: <br />1. application for a Special Use Permit was received on June 26, 2008. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />July 15, 2008 and all present were given a chance to freely speak at the hearing. <br />3. a Planning Commission recommended the City Council approve the request. <br />4. e City Council considered the application on July 22, 2008. <br />WHEle <br />AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp to the Special Use Permit (SP2008-013): <br />1.e property is zoned I — 1, Light Industrial. <br />2.e property is guided in the Comprehensive Plan for Light Industrial. <br />3.e applicant has proposed to erect a 125' monopole with a 10' lightning rod at 1565 1st <br />enue NW. <br />4.e proposed location of the tower would be located in the rear yard approximately 10' from <br />eastern lot line, over 100' from the northern lot line, 495' from the western lot line, and <br />proximately 500' from the southern lot line. <br />5. a proposed ground equipment would be located 10' from the eastern lot line and fenced in <br />r security purposes. <br />6.ction 4-600 (2 & 4) provides for several performance related standards that all wireless <br />lecommunication facilities must meet. <br />7. e Planning Commission and City Council determined the criteria of Section 4-600 (2 & 4) <br />e met. <br />8. a Planning Commission and City Council reviewed the proposal in accordance with the <br />Mowing additional Special Use Permit standards of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />11 detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />j impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />lI district. <br />q.
