Black noted that the large pile of dirt along the west side of Track 2 is clean till. This clean fill is being held for possible <br />use as a cover on the northern ten acres, while Ashland Oil is negotiating with the state on how extensively that area will. <br />ape cleaned. <br />AlYs building should be open next month; the opening has been delayed due to several interior changes. The 9,000 - <br />square foot building that would be constructed on the northern part of the APi site has been delayed until a tenant is found. <br />A letter has been sent from City staff to the APi requesting that they cover the difference in tax revenues that will result <br />from the delay. Staff has not yet heard a response. <br />East Side <br />Black reported that the Council has asked staff to wait on signing the grant agreement with the Metropolitan Council, <br />which would provide a portion of the funding for the dump closure. The Met Council requires that the development <br />include 20 affordable rental housing units. Sculthorp asked whether the housing would be Section 8. Black replied that <br />this is not a requirement. He added that there is already an agreement in place for twelve owner -occupied affordable <br />houses on the west side. Benke suggested that the City currently exceeds the affordable rental units required by the Met <br />Council and questioned why they are making this requirement. Black noted that this provision is included in all of their <br />grants. Harmon asked whether this requirement would limit the developers who would come forward. Black replied that <br />he didn't expect that it would, noting that the Rottlund proposal for the west side included some lower-cost units. Council <br />has directed staff to gather bids for the durnp closure. The contract is scheduled to be awarded ort September 8"' and <br />cleanup would start this fall. Harmon wondered whether the bid would be awarded if the Council declines the $1.4 <br />million grant from the Met Council. <br />Black reported that talks are still ongoing with JLT and Wischennann regarding their proposal for a Sheraton hotel on <br />Block A. T'he Council has decided that they are not willing to pay for the piling that would be required for the building, <br />but would be willing to lower the price of the land. It is anticipated that the City will hear from the developer in the next <br />few weeks. <br />Welson asked if Cummins was still interested in the Northwest Quadrant. Black replied that they are still interested; the <br />company is currently reviewing several possible sites and is expected to make a decision soon, Nelson asked whether the <br />cell tower has found a suitable location. Black replied that the Council has approved the relocation of the cell tower to <br />Mission Foods. Staff is working on a settlement agreement and the tower should move this fall. <br />Railroad 'Team Track and Wye <br />Fernelius announced that staff is working on the purchase of the Butcher's Spur; the closing is anticipated to take place in <br />sixty to ninety days. The Surface Transportation Board has approved the abandonment of the track and it would go into <br />effect on August 15`x'. Staff is currently talking with Minnesota Commercial and MT Properties about removing the tracks <br />where they cross Old Highway 8, so the City can complete the upgrade of the road. <br />Other Business <br />Black gave an update on several projects that have been ongoing within the City. Dalco has finished its warehouse <br />expansion, but will need to complete construction of a storrnwater retention pond. The USPS carrier annex will be <br />finished by mid-September and open on October I". The USPS retail site has started construction and should take four to <br />five months to complete. The Brighton Village redevelopment is complete and a Mexican restaurant will fill out the rest <br />of the retail site. The Homewood Suites hotel, at the corner of Old Highway 8 and Highway 96, has been slow to start <br />construction, but has now received a key approval letter from the MPGA. Building plans have been submitted for review, <br />A developer is interested in a small parcel of land by the Garage of New Brighton; however the proposed plans have not. <br />met the parking requirements. <br />Benke asked for an update on building pen -nit activity this year.
