PLANNING COMMISSION PROCEEDINGS <br />CITY OF NEW BRIGHTON <br />Regular Meeting — August 19, 2008 at 7:00 p.m. <br />Present: Commissioners Larry Baker, Jim O'Brien, Steve Danger, Bruce Howard, and <br />Norm Schiferl. <br />Absent: Tom O'Keefe, and Paul Zisla. <br />Also Present: David Phillips, Council Member, and Janice Gundlach, City Planner. <br />Agenda Review: Agenda was an amended to add an update regarding the Tank and <br />Tummy car wash and was then approved. <br />Minutes: Minutes for July 15, 2008 were approved. <br />Council Action: Council Member Phillips reported a new ordinance on the use of <br />eminent domain within the City was passed by the Council. The new ordinance requires <br />a four-fifths majority for approval and additional hearings would be held. He added that <br />the Council has not further addressed the two housing plans for the Northwest Quadrant <br />that were submitted several months ago. Baker inquired if Council would be making a <br />recommendation regarding a cell tower ordinance. Phillips stated that it would be <br />• discussed at a work session in October. <br />Public Hearing: SP2008-015 Special Use Permit to Permit Construction of a Garage in <br />Excess of 624 Square Feet <br />The applicant is requesting consideration of a Special Use Permit to allow construction of <br />a new detached garage in excess of 624 SF at 2871 14`h Street NW. The property <br />currently contains a 20' x 26' detached garage at a side yard setback less than the <br />required 5'. With this proposal the existing garage would be removed and a new 20' x <br />36' garage would be constructed in generally the same location, but meeting the required <br />5' side yard setback. <br />Motion by Howard, second by Schiferl TO CLOSE THE PUBLIC HEARING. <br />5 ayes, 0 nays. MOTION APPROVED. <br />Baker stated that there is a discrepancy on the drawing by the contractor versus the <br />survey regarding the location of the garage and recommended that the homeowner have it <br />clarified. <br />Motion by O'Brien, second by Howard to ADOPT THE ATTACHED RESOLUTION <br />• RECOMMENDING APPROVAL OF THE SPECIAL USE PERMIT, SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />
