RESOLUTION NO. <br />08-086 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />XTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND NONCONFORMING USE <br />an application has been made by Norm Wells on behalf of Bell Lumber & Pole <br />to permit construction of a 2,240 SF office addition to the existing office building <br />uction of additional surface parking stalls at 778 1" Street NW, and, <br />'HE AS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan and Nonconforming Use Permit were received on August 29, <br />2. ffhe Planning Commission, pursuant to published and mailed notices, held a public hearing <br />Dn September 16, 2008 and all present were given a chance to freely speak at the hearing. <br />3. 1 he Planning Commission recommended conditional approval on September 16, 2008. <br />4. applicant submitted a revised Site Plan, as directed by the Planning Commission, on <br />Lhetember 17, 2008. <br />5. ' he City Council considered the request on September 23, 2008. <br />✓HEI AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp c ct to the Site Plan (LP2008-007) and Nonconforming Use Permit (NC2008-005): <br />1. e property is zoned I - 2, Heavy Industrial. <br />2. e property is guided in the Comprehensive Plan for Business Park. <br />1. 1he applicant is proposed to construct a 2,240 SF addition to the existing office building and <br />nstruction of 7 additional surface parking stalls along the western property boundary. <br />4. 1he Planning Commission and City Council considered the Site Plan in accordance with I - 2 <br />strict standards of Section 6-150, the commercial performance standards of Section 6-390, <br />5. td the parking standards of Chapter 11 of the Zoning Code. <br />e Planning Commission and City Council found all applicable Site Plan standards to be <br />6. a Planning Commission and City Council determined the following nonconformities <br />(list on the site: <br />Parking areas less than the required setback. <br />14 Storage areas less than the required setback <br />Odor detectable beyond the lot line <br />Lack of concrete curbing & bituminous or concrete drive -aisles - i.e. dust <br />Fence heights and locations taller than allowed by code <br />7. a Planning Commission and City Council considered the Nonconforming Use Permit in <br />cordance with Section 8-460 (2) and the following criteria: <br />The total number of nonconformities is reduced. <br />The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />UNITY DEVELOPMENT\9-23-2008\LP2008-007, NC2008-005 (Bell Pole) — RESOLUTION.doc <br />1 <br />
