PLANNING COMMISSION PROCEEDINGS <br />• <br />Regular Meeting — September 16, 2008 at 7:00 p.m. <br />Present: Commissioners Larry Baker, Jim O'Brien, Tom O'Keefe, Steve Danger, <br />Bruce Howard, Norm Schiferl, and Paul Zisla. <br />Absent: David Phillips, Council Member. <br />Also Present: Gina Bauman, Council Member, and Janice Gundlach, City Planner. <br />Agenda Review: Agenda was approved. <br />Minutes: Minutes for August 19, 2008 were approved. <br />Council Action: Council Member Bauman reported that Council has proposed a 2.04% <br />levy. She added that they will continue to work on lowering further by December. The <br />Task Force has recommended that the City review the site plan for the Northwest <br />Quadrant. The Task Force will continue to meet twice a month, with the first meeting off <br />camera and the second meeting video taped. <br />Public Hearing: LP2008-006, SP2008-018, VN2008-003 Site Plan, Special Use Permit, <br />and Variance to Permit Construction of a Patio in the Front Yard at 563 Old Highway 8 <br />NW <br />The applicant is requesting a Site Plan, Special Use Permit, and Variance to permit <br />construction of a 15' x 30' patio on the west of the building along Old Highway 8 NW. <br />The purpose of the patio is to provide an area where patrons of the Eagles can smoke. <br />The Special Use Permit would allow beverages and food to be brought onto the patio area <br />or served on the patio. Lastly, the applicant is requesting a Variance to allow the patio to <br />be constructed with the required 30' front yard setback. The patio itself would be located <br />15.5' from the right-of-way line of Old Highway 8 NW. <br />Schiferl asked if the applicant was in favor of the alternate location for the patio that was <br />provided by staff. Don Johnson, President of the Eagles, replied that the alternate <br />proposed location is not financially economical at this time, because the driveway would <br />need to be relocated. He showed pictures of several businesses in the City that have a <br />similar set back to what they are requesting. Baker asked the applicant if they had <br />considered the effect of traffic on the patio. Johnson replied that traffic should not be an <br />issue and the patio would be safer than the Dairy Queen patio since it would be fenced. <br />Danger asked if the applicant had received quotes on the cost of moving the patio the <br />other proposed location. Johnson stated that it would cost roughly $30,000 to move the <br />driveway in addition to building the patio. He added that they considered every option <br />and this location is most cost efficient. <br />0 <br />
