RESOLUTION N0.08-095 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />f MAKING FINDINGS OF FACT AND APPROVING A REVISION TO THE PREVIOUSLY <br />SITE PLAN AND NONCONFORMING USE PERMIT PER RESOLUTION 08-086. <br />:AS, a request has been made by Norm Wells on behalf of Bell Lumber & Pole Company to <br />t a revision to the Site Plan and Nonconforming Use Permit approved on September 23, <br />for 778 1" Street NW, and, <br />s, the procedural history of the request is as follows: <br />City Council adopted Resolution 08-086 on September 23, 2008 approving a Site Plan <br />Nonconforming Use Permit, subject to conditions. <br />2. lhe applicant met with staff on October 1, 2008 to discuss a revision to the previously <br />proved site plan due to the updated survey not matching the 1990 survey. <br />3. 1 he applicant submitted an updated survey and site plan on October 8, 2008. <br />4. e City Council considered the revised request on October 14, 2008. <br />WHEI t EAS, the City Council make the following Findings of Fact with respect to revisions to the <br />Site lan (LP2008-007) and Nonconforming Use Permit (NC2008-005) previously approved: <br />1. An updated survey was submitted dated October 7, 2008 depicting the existing office <br />ilding at a setback of 36 feet (35.69 feet) when 40 feet is required and the previously <br />proved Site Plan depicted 40 feet, thus creating a nonconformity not previously known. <br />2. 4n updated survey was submitted dated October 7, 2008 depicting the existing surface <br />)arking area at a setback of 23 feet (22.59 feet) when 40 feet is required and the previously <br />proved Site Plan depicted 36 feet, thus increasing the impact of the nonconformity <br />previously known. <br />3. A revised Site Plan proposes an increase in square footage from the previously approved <br />2,240 SF by 64 SF to 2,304 SF. <br />4. A revised Site Plan has been submitted illustrating the proposed 2,304 SF office addition at a <br />foot setback from the front lot line, resulting in a four foot jog of the southern wall from <br />e existing office building. <br />5. 4revised Site Plan has been submitted illustrating additional improvements to the surface <br />rking area to the north of the addition, meeting all requirements. <br />6. The nonconformity of the existing building being setback 36 feet when 40 feet is required <br />nnot be practically eliminated. <br />7. The nonconformity of the existing building being setback 36 feet when 40 feet is required <br />ll be reduced with the proposed addition being jogged four feet to meet the setback and <br />dated foundation landscaping. <br />8.
