9. *us, the following additional nonconformity exists, not previously noted in Resolution 08 - <br />Existing office building setback 36 feet when 40 feet is required. <br />Now HEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the request for a <br />revision to the previously approved Site Plan (LP2008-007) and Nonconforming Use Permit <br />(NC 2 008-005), per Resolution 08-086 are hereby approved, subject to the following conditions: <br />Continued compliance with the conditions of Resolution 08-086 adopted on September <br />23, 2008. <br />The two surface parking stalls located within the front yard setback are screened with <br />four evergreens as depicted on the revised site plan dated October 8, 2008. <br />The applicant verifies that all outdoor storage piles do not extend above the height of <br />the existing fence. <br />The City Council recognizes extensive nonconformities with regard to setbacks of <br />outdoor storage piles and that these nonconformities cannot be practically reduced at <br />this time. <br />this 14th day of October, 2008. <br />___, Steve Larson, Mayor <br />1OPMENT\10-14-200MRevised LP2008-007, NC2008-005 (Bell Pole) — <br />RESOLUTION.doc <br />2 <br />
