Page 5 of 8 <br />Aye: Councilmember Doffing <br />Nays: Mayor Larson, Councilmembers Bauman and Burg <br />Abstention: Councilmember Phillips <br />Paul Zachman, 503 Silver Lake Road expressed his opposition to the project, primarily for the safety <br />issue. Councilmember Bauman reported the proposed sign is not illegal, and meets the City's Zoning <br />code requirements. <br />Jeanne Bartlett, 581 Silver Lake Rd requested replacing the current sign by placing the new sign in the <br />same location as the current sign. Mr. Holmberg responded that the location was a significant reason <br />for replacing the sign, and would likely not replace the sign if required to use the current location. <br />Tish Woods, a New Brighton resident and an attendee of Salem Covenant Church stated she is in <br />favor of the proposed sign because the current sign really is not visible from the street; also Ms. Woods <br />reported the Public Safety Department has evaluated the situation and determined there is not a safety <br />concern associated with the project. <br />Gail Rohrbacher concluded that the residents were not pleased with the size and location of the sign, <br />and invited council to observe the intersection in order to see the volume of traffic. <br />Councilmember Phillips addressed the neighbors of the church, he stated the signs really don't "flash" <br />as suggested; they actually "change." Also Councilmember Phillips noted the photos displayed were <br />very helpful to see the impact the proposed sign would have. <br />Mayor Larson acknowledged those residents who corresponded with the City. <br />Motion by Councilmember Buri seconded by Councilmember Bauman to adopt the attached <br />Isresolution approving the request as submitted and with the revised condition, deleting nurnber <br />10, and changing condition number 2 as per city code. <br />3 Ayes, l Nays;1 Abstention -Motion Carried <br />Ayes: Mayor Larson, Councilmembers Bauman: and Burg <br />Nay:: Councilmember Doffing <br />Abstention: Councilmember Phillips <br />1. Don Johnson on behalf of the New Brighton Eagles 3718 requests approval of a <br />Site Plan and Special Use Pen -nit to permit construction of a 15' x 30' outdoor <br />dining patio at 563 Old Highway 8 NW. Report No. 08-296. <br />Resolution No. 08-101. <br />City Planner Janice Gundlach gave a brief overview of the request. The Planning Commission <br />recommended approval at their meeting on October 21, 2008. An example concept photo was <br />displayed. Councilmember Phillips requested an additional condition be added to the resolution; <br />requiring the applicant to obtain an amended liquor license when obtaining a building permit for the <br />patio. The height of the fence was discussed, and it was determined that the code does not allow a <br />fence higher than 3 %Z feet. Director of Public Safety Bob Jacobson explained the process of amending <br />the liquor license to accommodate a patio. <br />1.
