<br />\ <br /> <br />; i <br />i I <br /> <br />.! <br />i I <br /> <br />RESOLUTION No. 02-091 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVAL OF A PLANNED RESIDENTIAL <br />DEVELOPMENT (PRD) PRD02-002, LP02-009, FP02-002; <br /> <br />WHEREAS, an application has been made by Humphrey Engineering and Nedegaard Custom <br />Homes to be considered for final PRD review by the City Council. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for PRD, Site Plan, and Preliminary Plat was filed with the City of New <br />Brighton on June 28, 2002. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a pUblic <br />hearing on July 16, 2002 and all persons present at the hearing were given an <br />opportunity to be heard. The Planning Commission considered the plans and <br />recommended preliminary review approval subject to conditions. <br /> <br />3. The City Council granted preliminary concept approval (Resolution 02- ) on July 23, <br />2002. <br /> <br />4. An application for a Final Plat and a final PRD review was filed with the City of New <br />Brighton on August 30, 2002. <br /> <br />5. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on September 17, 2002 and all persons present at the hearing were given an <br />opportunity to be heard. <br /> <br />6. The Planning Commission considered the plans and tabled the item until the October <br />15,2002 meeting. <br /> <br />7. The Planning Commission, continued the public hearing originally held on September <br />17 and all persons present at the hearing were given an opportunity to be heard and <br />recommended final review approval subject to conditions. <br /> <br />8. The City Council reviewed the application on October 22, 2002. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect to PRD02-002, <br />LP02-009, and FP02-002: <br /> <br />1. The site is zoned R-3B. <br /> <br />2. Under a Planned Residential Development preliminary approval process, increased <br />density, height limitations, and land uses are reviewed and considered. <br /> <br />3. The proposed height of the townhomes will be 32 feet at the highest point. <br /> <br />4. The application has gone through the PRD Review Process and the Planning <br />Commission has recommended the Preliminary Review to the City Council. <br /> <br />5. The proposed units for the PRD include 21 proposed townhome units. <br /> <br />6.
