The City Council reviewed the application and found the application to meet the <br />standards within Section 7-100 of the Zoning Code. <br /> <br />Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />PRD02-002, LP02-009, and FP02-002 is hereby approved subject to the following <br />conditions: <br /> <br />1. Approval by the Rice Creek Watershed District. <br />2. That within the Association by-laws the submitted snow removal plan is <br />inserted. The language shall be reviewed and approved by City Staff. <br />3. The final grading and utilities plan shall be subject to the review and approval of <br />the City Engineer. <br />4. The City shall install the sanitary sewer and watermain utilities through a City <br />administered contract. The developer shall petition the City to have these <br />utilities installed. The utilities will be paid for by the developer either through the <br />special assessment process or a letter of credit. <br />5. That the street be posted as a fire lane - no parking. <br />6. The pond shall be owned by the homeowners association. <br />7. The capacity of the pond is maintained by the homeowners association at the <br />design standard of the approved grading & drainage plan. <br />8.
