Rombacher, next-door neighbor 2 houses in from Silver hake Road and Inca Lane, <br />opposes the sign due to safety issues and believe the sign would increase the risk of an <br />accident. <br />Paul and Carla %achman, 503 Silver Lake Road, opposes the sign due to devaluation to <br />property, and safety issues. <br />Schiferl stated that he sent an email From himselfand his wife that they oppose this sign <br />due to safety concerns. <br />Rombacher asked the applicant why they would need a sign. Larry replied that the <br />existing sign is poorly located and difficult to read. The new sign would improve the <br />communication of the church for events at the church and within the community. Also, <br />the existing sign is falling apart. Baker asked how often the sign would change. harry <br />replied that it would depend on the how many messages need to be put out on a particular <br />day. Baker stated that he believes eight seconds is extreme for a residential area and <br />would recommend that the sign text to stay up longer. Howard asked staff if they have <br />the ability to regulate the sign's font and flash time. Gundlach replied that if' the <br />applicant meets the standards of the sign code they would be approved. If the <br />commission decides to limit the sign's font or flashing ability it may need to be tied to the <br />health, safety and welfare of the code and would need to be considered by the City <br />Attorney. She stated that there is no evidence that dynamic signs impact traffic safety. <br />Phillips stated that the sign is significantly dimmer at night and the commission could <br />recommend turning the sign off between the hours of 11 pm to 6 am. Gundlach stated <br />that a condition of turning off the sign should be tied to the health, safety and welfare <br />section of the code. <br />Motion by O'Brien, second by %isla to CLOSE THE PIJBLIC HEARING. <br />6 ayes, 0 nays. MOTION APPROVED, <br />Howard asked if there were additional accidents due to the sign what recourse the City <br />would have. Could the Commission approve the sign conditionally and review the traffic <br />accidents in a year and then formally approve it. Fernelius stated that hours of operation, <br />size, and placement should be done through conditions of the special use permit. But the <br />ordinance could possibly be revisited if needed. <br />O'Brien recommended continuing the Public Hearing, , to gain inforl-nation from the City <br />Attorney regarding hours of'operation and frequency of changes. <br />
