location of the Property; the use restrictions placed on the Property; and the easement rights granted <br />to the EPA and MPCA hereunder. <br />N. As further consideration, City police shall routinely monitor the Property on a regular <br />schedule for security purposes during the implementation of the Response Actions, including <br />operations and maintenance, and the City shall notify EPA and MPCA of any security concerns. <br />The City shall provide snow removal for access to remediation equipment installed at the Property <br />as part of the Response Actions. <br />O. As further consideration for the United States' covenant not to sue for damages to <br />natural resources, the City shall pay the United States on behalf of DOT the sum of Four <br />Thousand Five Hundred and 00/100s Dollars ($4,500.00) within sixty (60) days of the Effective <br />Date of this Agreement. Such payment shall be made by certified or cashier's check payable to <br />the "U.S. Fish & Wildlife Service," shall reference the Site name, the Site location, Account <br />Number 14X5198, the City's name and address, and shall be sent to: <br />Chief, Division of Finance <br />U.S. Fish & Wildlife Service <br />4401 North Fairfax Drive, Room 380 <br />Arlington, Virginia 22203 <br />P. This Agreement is in the public interest. The City's acquisition of the Property, the <br />City's fulfillment of its responsibilities under this Agreement, and the City's provision of <br />redevelopment assistance to future users and owners of the Property, will facilitate redevelopment, <br />will encourage productive use of the Property, and will assist in the implementation of Response <br />Actions consistent with the National Contingency Plan and the Remedies selected for the Site. <br />V. ACCESSaMIMANM. <br />A. The EPA and MPCA, their authorized officers, employees, representatives, and all other <br />persons performing Response Actions under EPA or MPCA oversight shall have: (i) a right of <br />access at all reasonable times to enter and perform Response Actions at the Property; and (ii) a right <br />to. enter and cross any other property under the control of the City for purposes of gaining access to <br />the Property to perform and oversee any Response Actions at the Property. The City shall provide <br />the EPA and MPCA with vehicular access across property under the control of the City to those <br />areas of the Property needed by the EPA and MPCA for the performance, oversight, or monitoring <br />Now Brig /MecC#igis & Gibbs <br />Agreamment & Covenant Not to Sue <br />648734 -4 - June 26. 1997 - F=11 <br />
