RESOLUTION NO. <br />08-108 <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A SITE PLAN AND SPECIAL USE <br />,S, an application has been made by Peter Murlowski of Timber Craft Enterprises to <br />development of a 4,469 SF commercial building and associated surface parking on the <br />1 150' of 2350 Palmer Drive, and <br />1HEI AS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan, and Variance were received on August 27, 2008. <br />2. 1he applicants for a Site Plan and Variance were deemed incomplete on September 9, 2008 <br />d the applicant was notified in writing of this. <br />3. 1 a applications for a Site Plan and Variance were deemed complete on September 10, 2008 <br />4. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />September 16, 2008 and all present were given a chance to freely speak at the hearing. <br />5.a Planning Commission considered the applicant on September 16, 2008 and tabled action <br />Tallow additional information to be presented. <br />6. 1 a Planning Commission continued the public hearing on October 21, 2008. <br />7. a Planning Commission continued the public hearing on November 18, 2008 to allow the <br />plicant the opportunity to apply for a Special Use Permit under the Palmer Drive Overlay <br />ea requirements. <br />8. ie applicant submitted an application for a Special Use Permit on November 26, 2008. <br />9. a Planning Commission considered the Site Plan and Special Use Permit at a special <br />teeting on December 2, 2008. <br />10. e City Council considered the requests on December 9, 2008 <br />THE AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Site Plan (LP2008-008) and Special Use Permit (SP2008-021): <br />1. a property is zoned B — 3, General Business. <br />2. e property is guided in the Comprehensive Plan for Community Business. <br />3. a legal description of the property is as follows: <br />e West 150.00 feet of Tract B, Registered Land Survey No. 237, Files of Registrar of <br />ties, Ramsey County, Minnesota. Subject to Palmer Drive. Subject to easements of <br />cord, if any. <br />4.e property proposed for development contains 20,250 SF of land area. <br />5. ge applicant is proposing to develop a 4,469 SF commercial building and associated surface <br />6. Ilie proposed building would include a second story, consisting of 1,839 SF. <br />
