VA <br />0 <br />to the commercial zoning of the property, a Site Plan must be considered in accordance <br />Zoning Code section 8-010. <br />Planning Commission and City Council determined the proposed Site Plan complies <br />all B-3 and Chapter 11 standards. <br />9.e proposed property lies within the Palmer Drive Overlay Area, which allows a reduced <br />arking setback of 10' by Special Use Permit. <br />10. c applicant has chosen to take advantage of a 10' parking setback adjacent to Palmer <br />11. The Planning Commission and City Council determined the following development <br />rameter findings of Zoning Code Section 5-650 have been met: <br />Enhanced Landscaping <br />. Pedestrian linkages to neighboring development for residents, employees, or shoppers <br />that use decorative crosswalk treatment types <br />Architectural styling compatible with Brighton Village at 1101 — 1151 Silver Lake Road <br />or adjacent uses in the overlay area. <br />14. Tie Planning Commission reviewed the proposal in accordance with the following Special <br />se Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />15. a Planning Commission determined all Special Use Permit criteria have been met. <br />NOW HEREFORE BE IT RESOLVED, that based upon the above findings of fact the applications <br />r a Site Plan (LP2008-008) and Special Use Permit (SP2008-021) are hereby approved, <br />bject to the following conditions: <br />Prior to release of any building permits, the applicant submits the $520 Special Use <br />Permit application fee. <br />The crosswalk treatment shall be a material other than paint and shall be extended to <br />the easterly drive at 2350 Palmer Drive. <br />The applicant implements additional landscaping to the north of the proposed building <br />to provide an enhanced buffer. The additional landscaping shall be acceptable to the <br />City Forester. <br />The applicant revises the dimensions of the shared trash enclosure/recycling receptacle <br />so as to meet the required 25' parking lot setback from the northern lot line. <br />The applicant withdraws the Variance request, in writing, at the time of building <br />permit or prior to the 60 -day expiration on January 6, 2008, whichever date comes <br />first. <br />A separate Resolution approving the Minor Subdivision is adopted by the City Council. <br />
