RESOLUTION NO. <br />09-011 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEw BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL, USE PERMIT. <br />JHE AS, an application has been made by Steve Trueman on behalf of AT&T Mobility to allow <br />co truction of a 61' low profile monopole, six panels antennas mounted flush with the pole, and <br />a 12' x 20' equipment shelter at 2400 Mississippi Street, as known at Well House # 12 and <br />Cr kview Park, and <br />7H AS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on January 9, 2009. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />F0,72 <br />January20, 2009 and all present were given a chance to freely speak at the hearing. <br />3. Planning Commission recommended the City Council approve the request on January <br />009. <br />4. ffbe City Council considered the proposal on January 27, 2009. <br />SHE AS, the Planning Commission and City Council make the following Findings of Fact with <br />resl i ct to the Special Use Permit (SP2009-001): <br />1. a property is zoned R — 1, Single Family Residential. <br />2. he property is guided in the Comprehensive Plan for Parks. <br />3. De applicant has proposed to construct a 61' low profile monopole within Creekveiw Park <br />Gated at 2400 Mississippi Street. <br />4. a proposed location of the tower would be approximately 110' from Silver Lake Road, <br />00' from Mississippi Street, 600' to the northern property line, and 700' to the eastern <br />overty line. <br />5. a proposal also includes construction of a 12' x 20' equipment shelter immediately <br />adjacent to the proposed pole. <br />6. The proposed pole would be dual-purpose in that the emergency siren would be relocated to <br />[lie top of the pole and the existing pole housing the emergency siren would be removed. <br />7. S ection 4-600 (2 & 4) provides for several performance related standards that all wireless <br />lecommunication facilities must meet. <br />8. 1 he Planning Commission and City Council determined those criteria of Section 4-600 (2 & <br />are met. <br />Q <br />Planning Commission and City Council reviewed the proposal in accordance with the <br />owing additional Special Use Permit standards of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />
