That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />10. a Planning Commission and City Council found the Special Use Permit criteria of Section <br />-130 are met due to the following: <br />The proposed park location is unique in that the tower would be located in the portion of <br />the park utilized for a well house and not within a publicly -used area. <br />The topography of the park and the orientation of the nearby residential homes to the <br />north, east and south are such that the proposed tower has limited visibility and no <br />residence has a clear view of the proposed tower. <br />Adequate vegetation exists along the north, east and south to provide for year-round <br />screening of the proposed tower. <br />A cellular tower currently exists at the park and the proposed tower would be consistent <br />in height with the existing tower. <br />The only locations were the proposed tower would visible would be from the commercial <br />businesses at the SW and NW corner of Silver Lake Road and Mississippi Street, where <br />no objections have been received. <br />The zoning criteria of Section 4-600 (2) & (4) have been met. <br />NowHEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the application <br />f a Special Use Permit (SP2009-001) is hereby approved, subject to the following conditions: <br />1. he tower is constructed in accordance with the plans on file with the City Planner dated <br />09/2009. <br />2. he proposed tower is engineered in such a manner that it may be extendable in the future <br />ould an additional carrier wish to co -locate on the tower.
