<br />ity of New Brighton <br />anuary 25, 1983 <br /> <br />(ouncil Business <br /> <br />I <br /> <br />Director of Community Development reviewed the staff <br />report and Planning Commission recommendation regarding <br />the request to construct a 500' radio tower in Jones <br />Lake. <br /> <br />Ms, Becky Comstock, attorney representing the applicant <br />was present to answer questions. <br /> <br />Councilmember Blomquist asked what the effect of the <br />City approval would be if the Department of Natural <br />Resources sUbsequently denied the application. <br /> <br />Director of Community Development stated that the <br />proposed resolution states that City approval would be <br />conditioned of the applicant1s receiving approval from <br />DNR and that if DNR approval was not obtained the City's <br />special use permit would be null and void. <br /> <br />Councilmember Janecek questioned to what extent the <br />applicant would correct any interference problems that <br />were a result of the tower construction and use. <br /> <br />I <br /> <br />Ms. Comstock stated that the applicant's had agreed to <br />correct interference problems directly resulting from <br />tne tower at their expense. Ms. Comstock noted further <br />that in a letter the applicant's had submitted they <br />have provided a phone number to call in the event of <br />problems. <br /> <br />Councilmember Benke stated that he would prefer not <br />to see strobe lights during the day. <br /> <br />Motion by Blomquist, seconded by Harcus to waive the <br />reading and adopt a RESOLUTION MAKING FINDINGS OF FACT <br />AND APPROVING APPLICATIONS FOR SPECIAL USE PERMIT, <br />SP-109 AND BUILDING PERMIT LP-137. <br /> <br />Motion by Janecek, seconded by Benke to amend the motion <br />by amending #6 in the resolution under NOW THEREFORE BE <br />IT RESOLVED to provide that "no daytime strobe lights" <br />shall be permitted. <br /> <br />I <br /> <br />Vote On Amendment <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Vote On Main Motion As Amended <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Mr. Jerry Svee, applicant was present to answer questions. <br /> <br />Director of Community Development presented a sketch <br />showing how the proposed modification of 12th Avenue was <br />to be completed. <br /> <br />-3- <br /> <br />SP-109, LP-137 <br />Jones lake <br />Radio Tower <br />Report #83-23 <br />Resolution # <br />83 - 0 7 <br /> <br />PRD-#35, PL-132 <br />LP-139 <br />Final PRD <br />Brighton Shores <br />Townhomes <br />Report #83-22 <br />
