Notice of hearing on proposed amendment to the enabling resolution of the New Brighton <br />Economic Development Authority. Report No. 09-055. Resolution No. 09-013. <br />City Manager Lotter reported that an ordinance was adopted July 22, 2008 restricting the Council's ability to <br />use eminent domain in the City of New Brighton. It was determined that the enabling resolution that initially <br />created the EDA in New Brighton should be amended to restrict the EDA from acquiring property by the <br />use of eminent domain. <br />Mayor Larson opened the Public Hearing at 6:38 pm. <br />Mayor Larson asked for comments: <br />Larry Kuechle (233916" Terrace) urged the Council to reconsider the restriction of eminent domain, for the <br />reason of possible difficulty in assembling a viable parcel for development purposes. Councilmember <br />Phillips explained the City of New Brighton still maintains the right to utilize eminent domain, this resolution <br />allows this decision to made solely by the City Council.
