<br />City of New Brighton <br />February 22, 1983 <br /> <br />I <br /> <br />whole procedure should be started over, and all parties <br />were agreeable to that. <br /> <br />Motion by Harcus, seconded by Schmidt to close the <br />Public Hearing. 5 ayes - 0 nayes - Motion carried. <br /> <br />No one present at the public hearing spoke to the issue. <br /> <br />Motion by Janecek, seconded by Benke to table PL-131 <br />indefinitely until such time as the applicant <br />requests that the application be reconsidered, and <br />to re-publish a public hearing notice when the <br />application has been re-filed. <br /> <br />5 ayes - 0 nayes - motion carried <br /> <br />Director of Community Development reviewed the <br />proposal for preliminary plat and PRD for 13 <br />single family lots and 12 townhomes. <br /> <br />I <br /> <br />Mr. Jim Thyen, applicant, was present and indi- <br />cated that three families were concerned about <br />rights and activities that were going to be going <br />on in the townhome open space area. Mr. Thyen <br />was not opposed to providing berming and land- <br />scaping as a condition to approval of the pre- <br />liminary plat. <br /> <br />Councilmember Benke stated that he thought the <br />proposal was good, however, he stated he was con- <br />cerned for providing restrictions on the use of the <br />townhome open space area. <br /> <br />Mr. Gary Walker, resident of 2871 Rice Creek Road, <br />spoke and indicated his concern about the proposed <br />townhouse development. He said that there would <br />be less than a 15 foot backyard. He also stated <br />a concern with how they were going to get two-way <br />traffic if they allow parking and if they have <br />visitors. Director of Community Development stated <br />that each unit will have a two-car garage and in <br />addition that there is overflow parking available. <br /> <br />Mr. Walker also expressed concern that the resi- <br />dents of the townhomes would encroach on his prop- <br />erty because the yards are so small. He felt he <br />was being asked to live next door to someone with- <br />out an adequate yard. <br /> <br />I <br /> <br />Mr. Thyen responded that if a town home resident <br />wanted a large yard, they could have purchased <br />a traditional single family home for the same <br />amount of money. Mr. Thyen stated that there <br />would be two-bedroom units so there would be few <br />children.
