<br />,~ Decemoer LL, l~tH <br /> <br />Councilmember Schmidt arrived at 8:10 p.m. <br /> <br />I <br /> <br />Mr. Roger SChilling, 1187 Mississippi Street, <br />was present to answer questions. Mr. SChilling <br />stated that he would like to install a retaining <br />wall along his property as well as along the <br />City right-of-way. <br /> <br />The Council discussed the situation regarding <br />the proposed retaining ,""all construc':ion and <br />the public right-of-way property ine_"uding <br />the fence on the right-of-way. <br /> <br />Mr. Schilling stated that to his knowledge <br />the fence was installed in 1971 by a previous <br />property owner who indicated that he had a 99 year <br />lease to maintain the pUblic property and was <br />required to carry liability insurance for the <br />property. <br /> <br />The Mayor indicated that he agreed that soil <br />erosion measures should be taken but he <br />questioned the use of public property for <br />private purposes. <br /> <br />I <br /> <br />After considerable discussion the City Council <br />acted in the following manner: <br /> <br />Motion by Blomquist, seconded by Benke to direct <br />staff to investigate the ownership of the various <br />parcels' involved and any restrictions on these <br />properties, to investigate the ownership and <br />need for the fence, and to defer action on the <br />request for the retaining wall to the January 12, <br />Council meeting. <br />5 ayes - 0 nayes - motion carried <br /> <br />Public Hearings <br />The D~rector ot Conununity Development reviewed <br />the chronology of the downtown development <br />area, Griffis property and the Beisswenger/ <br />Asphalt Company/Miller property. <br /> <br />Mr. Jim Casserly, O'Connor and Hannan, bond <br />counsel, reviewed the development district <br />plan amendment and indicated that what the <br />Council has is a plan by design and does not <br />commit the Council to any specific action. <br /> <br />Ms, Ar 1111,l/ae1 ti, representing 0 'Connor and Hannan, <br />I reviewed the development district plan amendment <br />and tax increment plans stating that the Council <br />has be},lre it documents that are both a planning <br />l),,)l and financing tool which indicates the projects <br /> <br />-3- <br /> <br />.. <br /> <br />Retaining Wall <br />Rice Creek <br />Report No. 81-280 <br /> <br />.. <br /> <br />1982 <br /> <br />Development <br />District Tax <br />Increment Finance <br />Plan <br />Report No. 81-271 <br />8:30 - 9:30 <br />RESOLUTION #2542 <br /> <br />. <br /> <br />(1 <br /> <br />~- <br />
