S ayes - 0 nayes - motion carried rc'!otion by Harcus, seconded by Blomc::'Jist to authorize the construction of a rip rap construction retaining wall on the City owned right-of-way along Rice Creek adjacent to 1187 Mississippi Street due to finding that it is in the public intere t to do so due to safety, aesthetic, public access and maintenance consideraticns. Further, that approval is subject to the adjacent property owner providing a written agreement including a liability insurance policy on the property, holding the City harmless of all dangers of liability, agreeing to allow public access, and agreeing to maintain the property. Motion by Benke, seconded by Janecek to amend the motion to include the requirement that the City Attorney review and approve the ,~pp1icant' s written agreement prior to commencment of construction.
