It provides guidance in determining <br />when a Section 6(f) conflict will result from a proposed <br />action and the procedure and documentation to be used in <br />requesting approval of the use conversion. <br /> <br />Determinin~ Section 6(f) Applicability <br /> <br />When a change in use of Fund-assisted land is contemplated by the sponsor, <br />a determination has to be made by,fir$t, the State Liaison Officer, and <br />ultimately by. ,the Bureau. a~'to.Wl1~ther a Sect!o1l.. 6(f) conflictw!ll result. <br />If it is found that a Section 6(f) conflict will result and the conversion :>',,: <br />) ,". ,.."'1"." '.-' '"'''.', -,' /",' .,' .,' <br />of use is approved by the Bureau, then it is necessary to acquire replace- <br />ment land ~ubject to the requirements noted in this insert. Only land <br />will satisfy the provisions of Section 6(f). The value of new capital <br />improvements or a reimbursement to the Fund will not be acceptable. <br /> <br />It is necessary initially for the SLO and the BOR to review the project <br />agreement and supporting documents to determine the project scope and to <br />aS6ure that the lands proposed for a conversion of use fall within that <br />scope and thus within the purview of Section 6(f). <br />I ' <br /> <br />If thc subjeet', lands are considered part of th~ project scope, the <br />Bureau would generally consider a conversion of use to occur if one <br />of the following actions were to be taken: <br /> <br />1. Granting by the participant to another party control. or pArtial <br />control, of the land which would result in uses other than public <br />outdoor recreation as approved by the Bureau. This includes granting <br />control of the land for the construction and maintenance of a utility <br />line, pipeline, irrigation ditch, road, or other sittd.lar facility. <br />It applies whether the int=~sion is above or. belov gr.ound lev~l. A <br />possible exception could occur if the partiCipant, without relinquishing <br />any control over the area, would allow a n(ln-O\mer to construct a water <br />line, p::fpeline, underground ut.ility, or similar construction which would <br />not impair the present and future recreational use of the property and <br />the surface area would be restored to its preconstructio:l condition. <br /> <br />2. .
