<br />I <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />August 24, 1982 <br /> <br />The City Planner noted that recent discussions <br />with the City Attorney indicate that before <br />the plat can be finalized a small portion of <br />property that was acquired as street right-of-way <br />must be vacated before title can be transferred <br />to the applicant. <br /> <br />PRD-34, PL-l30, <br />Leier Estates <br />Report No. 82-204 <br /> <br />The City Planner stated that it was staff's <br />recommendation that final consideration of <br />PRD-34 and PL-130 be continued until the <br />next Council meeting and further that the <br />City Council call a public hearing for the <br />next Council meeting to consider vacation <br />of the street right-of-way. <br /> <br />Mr. Gordon Hedlund, applicant, stated that he <br />was extremely upset by the process that has <br />transpired to date. Mr. Hedlund stated that <br />it is not his responsibility to remove the <br />garage slab, that the City spread peat over his <br />lots when the peat was to be removed, that the <br />street as constructed does not allow for on-street <br />parking and that the curbs are not appropriate given <br />that the property is undeveloped. Mr. Hedlund <br />stated that all the delays caused by the City <br />have been extremely costly and frustrating and <br />he feels he has been harassed. <br /> <br />The City Engineer noted that Mr. Hedlund had been <br />paid to remove the garage and slab as part of <br />the road improvement project contract and that <br />the slab was still in place. <br /> <br />Mr. Hedlund stated that he no longer had the <br />responsibility to remove the slab since he had <br />sold the property. Mr. Hedlund lastly stated <br />that he was very much opposed to a condition of <br />the final approval being that the homes must be <br />compatible with the surrounding properties. <br /> <br />The City planner noted that the PRD process provides <br />for the Council to determine whether or not the <br />proposed project is compatible with the neighborhood <br />in regard to type, height, location, and bulk of structures. <br /> <br />Motion by Janecek, seconded by Blomquist to continue <br />consideration of PRD-34, PL-l30 until the next Council <br />meeting and to call a public hearing to consider the <br />vacation of certain road right-of~ways in the <br />proposed Leier Estates subdivision for the next <br />Council meeting at 7:35 p.m. <br />5 ayes - 0 nayes - motion carried <br /> <br />-11- <br />
