C. Ernst,II. <br /> <br />The City Planner noted that the applicant has <br />requested a continuance in order to provide new <br />information to the Council in response to the <br />Planning Commission's concerns. The City Planner <br />noted that the new information could, in effect, <br />be considered a new application and as such should <br />require a public hearing and re-notification of <br />the public hearing to area residents. <br /> <br />Councilmember Schmidt noted that he was present <br />at the Planning Commission public hearing regarding <br />SP-I06 and that there was significant opposition <br />and concern for this request. Councilmember Schmidt <br />stated that there is no basis for this amusement <br />center to be operating as no permits have been granted <br />and that if consideration of this request is continued <br />the business should be discontinued. <br /> <br />Motion by Schmidt, seconded by Blomquist to waive <br />the reading and adopt a RESOLUTION MAKING FINDINGS <br />OF FACT AND DENYING APPLICATION FOR SPECIAL USE <br />PERMIT, SP-106 and to direct staff to order the <br />applicant to discontinue operation of the amusement <br />center immediately. . <br />5 ayes - 0 nayes - motion carried <br /> <br />-10- <br />
