Not Approved <br /> language is: "architectural styling compatible with Brighton Village at 1101 — 1151 <br /> Silver Lake Road or adjacent uses in the overlay area." Schiferl stated that compatible <br /> does not mean "exact" and added that although the building is architecturally different <br /> than Brighton Village it could meet the requirement. Murlowski stated that several <br /> buildings surrounding Brighton Village are different and asked what adjacent uses are <br /> applicable for reference. He added that it is too late to dictate how the building should be <br /> designed, since this is the fifth time they have been before the Commission. Baker <br /> replied that the Commission has not commented about architectural design before <br /> because it was not part of the condition of approval; however it is now part of the <br /> condition of approval with the Special Use Permit, thus the reason for the comments. <br /> O'Keefe replied that he believes the applicants have made a reasonable attempt to be <br /> compatible with Brighton Village; however he agrees with Commissioner Baker that the <br /> two restricted parking spaces is not an enhancement and that enhanced landscaping could <br /> include the back yard. Zisla stated to move this project forward the entire site should be <br /> considered and believes that some enhancements should be included on The Garage site. <br /> He would like to see a decorative crosswalk added to the eastern curb cut. <br /> Murlowski stated that they would be willing to talk with the City Forester about <br /> extending the enhanced landscaping and extending the cross walk to the eastern entrance. <br /> Motion by O'Keefe, second by Zisla to RECOMMEND THE CITY COUNCIL APPROVE THE <br /> MINOR SUBDIVISION, SITE PLAN, AND SPECIAL USE PERMIT SUBJECT TO THE <br /> FOLLOWING CONDITIONS: <br /> 1. Prior to release of any building permits, the applicant submits the $520 Special <br /> Use Permit application fee. <br /> 2. The crosswalk treatment shall be a material other than paint. <br /> 3. The applicant withdraws the Variance request, in writing, at the time of building <br /> permit or prior to the 60-day expiration on January 6, 2008, whichever date <br /> comes first. <br /> 4. A separate Resolution approving the Minor Subdivision is adopted by the City <br /> Council. <br /> 5. Dedication of a Drainage & Utility Easement and Sidewalk Easement as noted in <br /> the Interoffice Engineering Memo dated October 16, 2008. <br /> 6. Submission of a Lighting Plan compliant with Zoning Code Section 11-010 (6) <br /> prior to City Council consideration. <br /> 7. Submission of a Shared Parking Agreement and evidence of its recording with <br /> Ramsey County prior to release of a building permit. <br /> 8. Submission of a Shared Access Agreement and evidence of its recording with <br /> Ramsey County prior to release of a building permit. <br /> 9. Removal of the existing driveway connecting the BP gas station at 1201 Silver <br /> Lake Road and The Garage at 2350 Palmer Drive. <br /> 10. Separate Sign Permits must be obtained from the City Planner prior to erecting <br /> any wall-mounted or ground signs. <br /> 11. The garbage and recycling enclosure must be with in required setbacks. <br />
