<br />I <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />June 23, 1981 <br /> <br />Public Hearings <br />The Acting Mayor directed receipt of letters <br />from adjacent property owners in the 200 foot <br />radius of the Walburn Industrial Park indicating <br />their waiver of right to notice. <br /> <br />The City Attorney indicated that the purpose <br />of the published and mailed notice was <br />to provide adjacent property owners the right <br />to come down and be heard regarding the public <br />hearing in question. <br /> <br />The City Attorney indicated that the Council <br />could go ahead and receive testimonies since <br />the public hearing notice had been published <br />and the Council may want to consider continuing <br />the public hearing ~nd permitting the mailed <br />notification to be given. <br /> <br />Dale Hebieson the surveyor for the project <br />and the plat was present to answer questions. <br />Mr. Hebieson reviewed the plat showing the <br />proposed road and three (3) proposed lots. <br /> <br />Mr. Dick Bury, applicant, and Mr. Rolf Worden, <br />attorney for the applicant, were also present. <br /> <br />Mr. Worden stated that he questioned whether <br />the Council could legally rezone the property <br />to a zoning classification (Limited Industrial) <br />that does not yet exist. Mr. Worden indicated <br />that he felt that his proposal should be <br />considered on its merits only and it should not <br />be tied to some other comprehensive planning <br />issue. <br /> <br />The City Council noted the proposed zoning <br />classification to Limited Industrial will <br />be adopted at tonights meeting and that the <br />classification itself has been discussed <br />for several years. <br /> <br />No one else present spoke to the issue. <br /> <br />Motion by Blomquist, seconded by Janecek to <br />continue the hearing on ?L-124 unti.l Augu$t <br />11, 1981 at 7:35 p.m. <br />4 ayes - 0 nayes - motion carried <br /> <br />-2- <br /> <br />'-, <br /> <br />7:41 - 8:20 <br />PL-l24, Walburn <br />Industrial Park <br />Report No. 81-126 <br />
