All towers may be inspected at least once eacb year by an official of the Building and Inspection Division to <br />determine compliance with original construction standards. Deviation from original construction for wbic:k a permit is obtained <br />constitutes a violation of this Se(:tion. <br /> <br />Notice of violations will be sent by registered mail to the owner and he wiD have 30 days from the date the notification is <br />issued to make repairs. The owner will notify the Building and Inspection Division that the repairs have been made, and as soon as <br />possible thereafter, another inspection will be made and the owner notified of the results. <br /> <br />(i) Violation.!. Any person who shall violate any of the provisions of this Section shall be guilty of a misdemeanor. <br /> <br />(It) Interpretation.. It is not the intention of this Section to interfere with, abrogate; or annul ImJ covenant or other <br />agreement between parties. provided, however, where this Section imposes a greater restriction upon the use of premises for <br />antennae or towers than are imposed or required by other ordinances, rules, regulations. or permits, or by convenants or <br />agreements, the provisions of this Section shall' govern. . <br /> <br />~ <br /> <br />0) VarialJCes. The issuing authority is hereby empowered to grant variances in the event it shall, after investigation, find that <br />such variance is not objected to by the adjacent property owners, does not unduly detract from the general plan of the City, and <br />that such variance is reasonably necessary to the owner of the property for the full use and development of the property, and would <br />be in the best interests of the City. Definitions. <br /> <br />The following words and (eI1IlS as used in this Article shall have the following meanings unless the context dearly indicates <br />otherwise: <br /> <br />Bloomington Historical &gister~a ranked listing of prehistoric and historic sites which is hereby incorporated and made a part <br />of this Article as if set out in full. <br /> <br />Class I Sites-sites and improvements which rank highest in tenns of associative value based on historical significance. <br />architectural quality, and community development impact and include the sites classified as such in the Bloomington Historical <br />Register. <br /> <br />Class II Sites-sites and improvements which rank next highest in terms of associative value based on historical significance, <br />architectural quality, and community development impact and include the sites designated as such in the Bloomington Historical <br />Register. <br /> <br />Demolish~when used with reference to buildings, structures, or improvements, includes partial demolition of such buildings. <br />structure, or improvement. <br /> <br />Improvement-a building. structure, Indian mound, wan, .:Ir other object constituting a physical betterment of real property. <br /> <br />Ordinary Maintenance (VId Repair~consists of painting of previously painted surfaces, caulking, regluing.. and maintenance <br />activities which use materials and techniques of the period and in the identical design and usage of the improvement being <br />maintained. <br /> <br />273 <br />
