KELLY <br /> <br />A"<EA CODE. 612 <br /> <br />224-376' <br /> <br />June 5, 1981 <br /> <br />City of New Brighton <br />803 - 5th Avenue N.W. <br />New Brighton, Minnesota 55112 <br /> <br />Attention: Mr. Jim Fornell <br />City Manager <br /> <br />Re: Proposed Ordinance to Regulate and License <br />Gambling <br /> <br />Dear Mr. Fornell: <br /> <br />I am enclosing a draft of the proposed Ordinance to regulate and <br />license gambling as authorized under Chapter 349 of the Minnesota <br />Statutes. <br /> <br />This Ordinance is being presented pursuant to a request by the <br />Eagles Club of the City of New Brighton which wishes to conduct a <br />raffle and sell chances on what is known as a tipboard on the 4th <br />of July. <br /> <br />It is believed that this Ordinance would provide for appropriate <br />licensing and controlling of any such operation and is authorized <br />by the Statute as stated above. <br /> <br />If the Eagles are to have a permit for July 4 and 5, 1981, they <br />will have to have the Ordinance adopted by the 23rd so that it can <br />be published and would also have to concurrently have an approval <br />by the council by the June 23rd meeting. Therefore, if it is the <br />council's indication that it wishes to pass such an ordinance and <br />grant the permit, then the Eagles should be encouraged to submit <br />an application listing their qualifications to come within the <br />purview of the ordinance and have council action scheduled for the <br />granting of the permit on the 23rd of June. <br /> <br />This can be done if the permit is then issued contingent upon <br />appropriate pUblication of the ordinance and the effectiveness of <br />it. <br /> <br />I have left the dollar amount blank in the draft as to the amount <br />of gifts that can be given. The statute previously limited it to <br />$15,000 for one year and $500 per one night or per one occasion. <br />
