City of New Brighton April 8, 1980 I Motion by Blomquist, seconded by Benke to find that in accordance with MEQC Rule number 24B.b and the New Brighton City Code that EAW is mandatory and the City of New Brighton is the responsible agency; that the Council in the review of the document finds that the proposed development addressed by the EAW does not require an EIS and that a Negative Declaration be filed with the EQC; and that said conclusion is based on the findings that: 1. The project is not a major action; 2. The project does not have the potential for significant environmental effects; 3. The project is not of more than local significance. The City Council further directs staff to submit the required copies of the EAW to the agencies that appear on the Official EQB Distribution List and any other interested persons. 4 ayes - 1 naye (Senden) - motion carried I Motion by Blomquist, seconded by Janecek to continue the hearing on PUD #1 and R-115 to April 22, 1980 at 7:S0 p.m. and further tb direct staff to work with the developer to address the following questions and concerns: 1. traffic and specifically the possibility of a total of three access points using County Road "E", Silver Lake Road and 5th Street. - 2. the generation of data on noise levels resulting from the night shift. 3. solicit the opinion of the City Attorney of the appropriateness of product assembly in a B-S district. 4. the access location on County Road "E" should be reviewed with the neighbors with the potential that the entrance could be moved somewhat to the east. 5 ayes - 0 nayes - motion carried Council Business The Police Chief was present to answer questions. Impounding Contract Sroga's Towing Report No. 80-61 I Motion by Janecek, seconded by Schmidt to authorize the Mayor and Manager to execute a towing, storage, and impounding contract with Sroga's Towing. 5 ayes - 0 nayes - motion carried -5-
