<br />...... <br /> <br />.. . <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />~ <br /> <br />REVISED DRAFT 10/5/79 <br />REVISED April 2, 1980 <br />REVISED April 28, 1980 <br /> <br />JOINT POWERS AGREEMENT REGARDING <br />DEVELOPMENT AND USE OF INDEPENDENT SCHOOL DISTRICT NO. 621 OUTSIDE FACILITIES <br />AT <br />HIGHVIEW MIDDLE SCHOOL <br /> <br />THIS AGREEMENT, made this ______.__day of ,,_______, 1980 between the CITY OF <br />NEW BRIGHTON, hereinafter referred to as the "CITY" and INDEPENDENT SCHOOL DIS- <br />TRICT NO. 621, hereinafter referred to as the "SCHOOL DISTRICT" <br />~J ITNESSETH : <br />WHEREAS, the School District owns and operates Highview Middle School, the <br />premises of which include certain outside facilities, said school site delineated <br />in red on the map attached hereto and made a part here of Exhibit A, and <br />WHEREAS, it is the mutual desire of the School District and the City to <br />cooperate for the purposes of permitting said outside facilities to be used for <br />the education and recreation activity programs of the School District and the <br />City, and <br />WHEREAS, the School District and the City desires to upgrade and maintain <br />the Highviewr1idd1e School outside facilities to permit utilization, not only by <br />the pupils of the School District, but also by the citizens of the School Dis- <br />trict and of the City, <br />NOW, THEREFORE, BE IT RESOLVED, that in consideration of the foregoing re- <br />. cita1s and mutual covenants and promises herein set forth, it is hereby agreed <br />'by and between the School District and the City as follows: <br />1. INSTALLATION, UPGRADING, MAINTENANCE AND REPAIR <br /> <br />The City agrees to participate in the maintenance and development <br />of the outside facilities at HighviewMidd1e School. <br />The City's contributions will consist of maintenance, in-kind <br />services and/or capital equipment for a 3 year total not to exceed <br />$15,000 for the years 1980, 1981 and 1982, unless this agreement has <br />been previously terminated pursuant to the provisions of paragraph 5. <br />A specific contribution agreement will be developed mutually by both <br />parties for the year 1980 within a reasonable time after the approval <br />of this Joint Powers Agreement. Specific contribution agreements for <br />the years 1981 and 1982 will be developed mutually by both parties <br />before March 15 in each of those respective years. <br />
