<br />., <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />~ <br /> <br />. . <br /> <br />-2- <br /> <br />The form and the amount of the City's and District's contributions <br />starting with the year 1983 and thereafter will be detailed yearly in a <br />contribution agreement between the City and the School District, <br />approved by March 15 of each year. <br />Should the contribution agreements not be mutually agreed to by <br />March 15, as stated above, or should the contribution agreements <br />mutually agreed to not be honored by either party, this Joint Powers <br />Agreement shall be jointly reviewed within ninety (90) days after <br />Ma rch 15 or from the da te the agreement was not honored. <br /> <br />2. EASEMENT FOR EGRESS AND INGRESS <br />The School District hereby grants to the City, its agents and em- <br />ployees, and participants in its scheduled recreational activities, <br />programs or events, an egress and ingress to said outside facilities so <br />long as this agreement is in effect. <br />3. INDEMNIFICATION <br />a. School District's indemnification of City. The School District <br />hereby agrees to indemnify and hold harmless the City, its agents <br />and employees, against any and all claims for damages, of whatever <br />nature, arising from or in consequence of the duties it has' assumed <br />hereunder and a"lso arising from or in consequence of its operation. <br />supervision. control or conducting of any of its recreational acti- <br />vities, programs or events or related activities utilizing said <br />outside facilities. <br />b. City's indemnification of School District. The City hereby agrees to <br />indemnify and hold harmless the School District, its agents and em- <br />ployees, against any and all claims for damages of whatever nature, <br />arising from or in consequence of the duties it has assumed hereunder <br />and also arising from or in consequence of its operation, supervision, <br />control or conducting of its recreational activities, programs or <br />events or related activities utilizing said outsi~e facilities. <br />c. Nature and extent of indemnification. The indemnification set forth <br />in the previous two subparagraphs of this paragraph 3 shall protect the <br />; ndemnitee and its successors, from and aga i nst any and all acti ons, pro- <br />ceedings, claims, demands. costs, damages and expenses, including <br />reasonable attorneys' fees which it may pay. sustain or incur. <br />
