The only exceptions are: <br />1) if the damage was caused by the City in the process of <br />excavating and repairing some other City owned facility, or <br />2) if the sewer service -fails within two (2) years from the date <br />of installation as a result of improper construction. <br /> <br />I agree that the 2 year~lJmitation,se~ms unfair-to a . <br />property owner who may ,build a home and connect to the sewer <br />service 15 years after the sewer service was installed. How <br />could he know if the service had failed within the first 2 years <br />or at some later date. On the other hand there has to be some <br />limit on the guarantee provided by the .City and on the basis of <br />the policy I would have to deny the claim. The property owner <br />does _have the right to appeal to the City Council if he does <br />not agree with this decision. <br /> <br />I personally think the sewer service at 1975 long Lake Road is <br />just grown full of tree roots. The type of sewer pipe used 15 <br />years ago was not that water tight and root growth in sewer <br />services is not uncommon. I've asked the sewer department to <br />rod the main sewer and this may also pull some of the roots out <br />of the sewer service. <br /> <br />.. <br /> <br />If"the sewer service at 1975 Long Lake Road continues to be a <br />problem and has to be excavated I would like to be notified to <br />look at it when it's exposed. <br /> <br />Please contact me if you have any additional questions. <br /> <br />Y01.X1Yp~ <br /> <br />Leslie J.
