The City Engineer shall direct an inspection of the <br />public water or sewer main to determine if the problem <br />exists within the City main or private service. If <br />the problem is within the private service the City <br />Engineer shall notify the property owner as to whether <br />Subsection 1, 2, or 3 apply. <br /> <br />1. If the problem is within the private water or sewer <br />service, and can be determined from Section 3 to be <br />the property owners responSibility, the City Engineer <br />shall notify the property owner orally and in writing <br />that the property owner is responsible for the <br />maintenance or repair work. If the maintenance or <br />repair work will necessitate excavation to the private <br />service, the property owner will be required to obtain a <br />City repair permit at no cost. If the excavation <br />will take place in the street or under the curb a <br />$200.00 deposit will be required to guarantee praper <br />repair of the street or curb. The excavator or <br />plumber doing the work must be licensed by the City. <br /> <br />2. If the problem can be determined from Section 3 to be <br />the City's responsibility, the City Engineer shall <br />proceed to make repair using City forces or con- <br />tractual services as deemed necessary. The City <br />Engineer shall notify the property owner that the <br />maintenance or repair work will be the City's <br />responsibility. <br /> <br />3. If responSibility for the repairs cannot be determined <br />from Section 3 without excavating the private service, <br />the City Engineer shall advise the property owner <br />orally and in writing to proceed with repairs, the <br />cost of which mayor may not be paid by the City. <br /> <br />A repair permit and street opening deposit as noted <br />in Subsection 1 above will be required and private <br />excavators or plumbers are required to be licensed <br />by the City. <br /> <br />I- <br /> <br />If the property owner's excavator or plumber excavates <br />the service and feels that the City is responsible for <br />the problem, the City Engineer must be contacted <br />immediately to make an inspection and determine <br />responsibility. If the determination is made that the <br />City is responsible as provided under Section 3, the <br />City Engineer shall make arrangements to pay the <br />repair bill or reimburse the property owner. <br />
