<br />'" . <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE NO. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING CHAPTER 10 OF THE NEW BRIGHTON CITY CODE RELATING TO <br />FOOD WAREHOUSING OPERATIONS. <br /> <br />The Council of the City of New Brighton does hereby ordain: <br /> <br />SECTION I. That Section 10-2 Definitions is hereby amended by adding <br />a definition (cc) for a food warehouse to read as follows: <br /> <br />(cc) Food Warehouse shall mean and include every building or <br />structure or any part thereof operated by a corporation, com- <br />pany, association, joint stock company or association, firm, <br />partnership, or individual, their trustees, assignees, or <br />receivers appointed by any court, for the storage or ware- <br />housing of food for compensation and licensed under Chapter 231, M.S. 1979. <br /> <br />SECTION I I. That Section 10-6 License Fees are hereby amended by adding <br />a new paragraph (g) to read as follows: <br /> <br />(g) Food warehouse license fee. The 1 icense fee for each food <br />warehouse shall be $15.00 per year. <br /> <br />SECTION I I I. That Section 10-10 be amended to read as follows: <br /> <br />Section 10-10 - Itinerant Food Establ ishment and Food Warehouse <br /> <br />a. Itinerant food establ ishments. Itinerant food establ ishments <br />shall comply with all the applicable provisions of this chapter, <br />and shall be constructed and operated in an approved manner; <br />provided, that specific requirements for physical facilities may <br />be waived by the health authority when suitable substitutes, which <br />in his opinion, will not result in an imminent health hazard, have <br />been provided. The health authority may prohibit the sale of <br />certain potentially hazardous foods to assure the service of whole- <br />some food. Before commencing operations of any kind, the licensee <br />hereunder shall notify the health authority that such food establ ish- <br />ment is ready for final inspection; and the health authority shall <br />immediately make an inspection and issue a report thereon;and no <br />itinerant food establ ishment shall commence operations until the <br />requirements of this chapter have been met in accordance with the <br />health authority's final inspection report. <br /> <br />b. <br /> <br />Food warehouse. Food warehouses shall comply with all the appl icable <br />provisions of this chapter, and shall be constructed and operated in <br />an approved manner; provided, that specific requirements for physical <br />facil ities may be waived by the health authority when suitable sub- <br />stitutes, which, in his opinion, will not result in an imminent health <br />hazard, have been provided. <br /> <br />The following standards shall however be considered minimum for a <br />food warehouse. <br /> <br />1. <br /> <br />At all times, including while being stored or transported, food <br />shall be protected from contamination by all agents, including <br />dust, insects, rodents, unnecessary handling, flooding, draining, <br />and overhead leakage or condensation. <br />Food shall be stored off the floor and away from the walls. <br />Food shall be properly rotated. <br />Food that is damaged shall be removed and isolated from the <br />remaining stock. <br />Food warehouses shall be provided with adequate, conveniently <br />located, and approved lavatory facil ities with hot and cold <br />running water, hand cleansing compound, and sanitary towels or <br />hand drying devices. <br /> <br />2. <br />3. <br />4. <br /> <br />5. <br />
