<br />I <br /> <br />I <br /> <br />I <br /> <br />" <br /> <br />.' ... <br /> <br />THIS AGREEMENT, by and between the City of' New Brighton, Minnesota, a <br /> <br /> <br />municipal corporation, hereinafter referred to as the "City," and the County <br /> <br />of Ramsey, a political subdivision of the State of Minnesota, hereinafter <br /> <br />referred 'to as the "County;" <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Tenth Street Northwest (County Road F), between the intersection <br />of Long Lake Road and 1-694 and Third Avenue Northwest, is wholly within the <br /> <br />City; and <br /> <br />WHEREAS, Tenth street Northwest is a County State Aid Highway--CSAH 45 <br />- I <br />from 1-694 to Eighth Avenue Northwest and CSAH ~2 from Eighth Avenue North- <br /> <br />west to Third Avenue Northwest; and <br /> <br />WHEREAS, the County and the City desire to construct and rebuild Tenth <br /> <br />Street Northwest; and <br /> <br />WHEREAS, the City has prepared a Preliminary Report for the upgrading <br /> <br />of Tenth Street Northwest; and <br /> <br />WHEREAS, this improvement includes, among other things, permanent right <br /> <br />of way, construction easements, storm sewer, sanitary sewer and services, <br /> <br />water main and services, concrete curb and gutter, concrete walks, landscaping, <br /> <br />grading, base and bituminous pavement; and <br /> <br />WHEREAS, this project has been designated as County Project S.A.P. 62-612-05 <br />and S.A.P. 62-645-03, and among other City designations, City Project-state Aid <br /> <br />Project No. 147-020-03; <br /> <br />NOW, THEREFORE, IT IS MUrUALLY AGREED AS FOLLOWS: <br /> <br />1. The County shall prepare the necessary plans, specifications, proposals, <br /> <br />take bids, tabulate bids, and with concurrence of the City, shall award a con- <br /> <br />-1- <br />
