<br />City of New Brighton <br />February 27, 1980 <br /> <br />I <br /> <br />Public Hearings <br />The City Planner reviewed the staff report. <br /> <br />The applicant, J. A. Cadwallader was present <br />to answer any questions. He stated that the <br />tennis courts were proposed to be moved at <br />the time the townhouses were to be constructed. <br /> <br />John White, 3404 Silver Lane, questioned the <br />location and access to the townhouses in reference <br />to the existing berm on Silver Lane. <br /> <br />The applicant stated that the existing berm <br />would not be altered and that the townhouses <br />would be constructed into the berm. <br /> <br />Wayne Leverkuhn, 1529 Long Lake Road, Chairperson <br />of the Planning Commission, voiced a concern over <br />the relocation of the tennis court and that the <br />relocation not result in the discontinuation of <br />use of the courts and result in any liability to <br />the applicant or the City. <br /> <br />PRD #30, PL-12l <br />Cadwallader, Silver <br />Hills <br />Report No. 80-l9 <br />7:53 - 8:15 <br />RESOLUTION #2302 <br /> <br />Motion by Senden, seconded by Benke to close the hearing. <br />4 ayes - 0 nayes - motion carried <br /> <br />I <br /> <br />Motion by Benke, seconded by Janecek to waive the reading <br />and adopt a RESOLUrrION MAKING FINDINGS OF FACT AND <br />APPROVING APPLICATION FOR A PRELIMINARY PLANNED RESIDENTIAL <br />DEVELOPMENT, PRD #30 AND A PRELIMINARY PLAT, PL-l21 and <br />to add items #19 and 20: <br /> <br />19. That the applicant dedicate a watermain easement on the <br />final plat to be subject to approval by the City Engineer. <br /> <br />20. That legal agreements be provided insuring the continuous <br />use of the tennis courts and resolve liability concerns <br />during property transfers. <br />4 ayes - 0 nayes - motion carried <br /> <br />Council Business <br />Mr:--wiJ.-y'n"e Leonard, Ramsey County Project Engineer <br />was present. He reviewed the proposed plans <br />and specifications for the upgrading of lOth <br />Street NW. <br /> <br />I <br /> <br />The Council questioned Mr. Leonard in regard <br />to the proposed signalization of lOth Street <br />at the 5th Avenue NW intersection. <br /> <br />Mr. Leonard stated the County proposed to erect <br />four-way stop signs at the intersection during <br />construction.
