<br />; , <br />i I <br /> <br />... <br /> <br />.;\ <br /> <br />RESOLUTION NO.o2-069 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT ApPROVING OF POO 02-002. <br /> <br />WHEREAS, an application for amending an approved Planned Unit Development and amending a <br />General Development Plan was made by BKV Group, Inc. for Pratt Ordway, Inc; and <br /> <br />WHEREAS, the procedural history of the application for the PUD is as follows: <br /> <br />1. The City Council approved PUDOO-OI(phase 1) and LPOO-6 on May 9, 2000; <br />2. The City Council approved PUDOO-Ol (Phase 2) and LPOO-7 on June 27, 2000; <br />3. The City Council approved PLOO-7 on August 22, 2000; <br />4. The City Council approved SPOI-07 regarding an Area of Special Control sign plan on <br />May 22, 2001 and, <br />5. The City Council approved LPOI-05 on May 22,2001. <br />6. The City Council approved PUDOI-0010n June 26, 2001. <br />7. The Planning Conunission held a Public Hearing to consider an amendment to the <br />General Development Plan (PUD 01-00 I) and reconunended approval to the City <br />Council of the amendment with conditions on August 20,2002. <br />8. The City Council reviewed the Planning Commission Reconunendation and approved <br />the Amended PUD with conditions on August 27, 2002. <br /> <br />NOw, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to PUD 00-002: <br /> <br />1. The subject site is zoned B-4, Downtown Business. <br /> <br />2. The building and site design for proposed amendment of the General Development Plan <br />for PUD02-002 are compatible with and compliment surrounding land uses. <br /> <br />3. The approved Site Plan and Planned Unit Development as depicted in plans and <br />drawings entitled Main Street Housing, New Brighton Minnesota, prepared by BKV <br />Group Inc. along with the plat, site plans, grading plans, utility plan, landscaping plans, <br />lighting plans, sign plans and elevations from the following previous Main Street <br />Development approvals:, PUDOO-Ol(Phase 1) and LPOO-6; PUDOO-Ol (Phase 2) and <br />LPOO-7; PLOO-7; SPOI-07, LPOI-05, and PUD02-002 is considered and is here in <br />referred to as the "General Development Plan." <br /> <br />4.
