0 c) Submission by Owner to City of evidence of payment by Owner of Owner's final <br />Approved Relocation Costs (with documentation acceptable to City), City shall issue a check <br />payable to Owner in an amount equal to all then unpaid Approved Relocation Costs, including <br />amounts withheld from prior payments for Approved Relocation Costs, less any deductions for <br />amounts owed by Owner pursuant to § 2.09 hereof and remaining unpaid ("Final Payment"). <br />2.07_ Disputes Regarding Relocation Costs. If City objects to payment of an expense <br />submitted by Owner for reimbursement as not being an Approved Relocation Cost identified in <br />Exhibit D, City shall so notify Owner within fifteen (15) days of receipt of the Owner's request <br />for payment of the expense. Owner shall have the right to resubmit the request for <br />reimbursement with additional information supporting the expenses and City shall have fifteen <br />(15) days following receipt by City of the resubmitted request for payment to make payment or <br />0 notify Owner that it will not do so. If City continues to take the position that the expense does <br />not fall within the Approved Relocation Costs identified in Exhibit D, or that the Owner has <br />failed to provide acceptable documentation of such payment, or the City otherwise refuses to pay <br />an amount claimed by Owner under this Agreement, Owner shall have the right to move the <br />Court for a declaration that the expense is reimbursable and an order requiring the City to <br />reimburse the expense. The judge's determination shall be final and the City shall pay the costs <br />of the proceeding as provided in Minn_ Stat. § 117.52, Subd. 4. <br />2.08. Waiver and Release. <br />a. Subject to performance by City in accordance with this Agreement, Owner waives <br />any and all rights to further notices, viewings, or hearings regarding the instant condemnation <br />action and releases City from all further claims arising from this proceeding, except as may be <br />required to enforce this Agreement. <br />5 <br />
