0 b. Subject to performance by Owner in accordance with this Agreement, City waives <br />any and all rights to further notices, viewings, or hearings regarding the instant condemnation <br />action and releases Owner from all further claims arising from the proceedings, except as may be <br />required to enforce this Agreement. <br />2.09. Possession Rent Utilities Taxes and Insurance. City agrees that Owner may <br />continue to occupy the Subject Property under the terms of the Lease, which terms shall be <br />binding upon both Parties until Owner relinquishes possession of the Subject Property, if and to <br />the extent that Owner complies with the following requirements: <br />a) Possession. Owner may occupy the Subject Property until no later than 5 p.m. on <br />June 30, 2009. Owner may relinquish possession of the Subject Property to City <br />at any time prior to June 30, 2009, by giving at least five (5) days written notice to <br />City of the date that Owner is vacating the Subject Property and relinquishing <br />possession to City. Owner shall have no further right to occupy or enter the <br />Subject Property after the effective date of this notice or June 30, 2009, whichever <br />shall first occur. <br />b) Rent. Owner shall continue to pay rent to the City for the Subject Property, in the <br />amount of $695.67 per month, due and payable on or before the first day of each <br />month, until the date on which Owner's obligation to pay rent for the Relocation <br />Site commences (to the extent Owner actually pays rent for the Relocation Site <br />and provides documentation of such payment to City). Owner shall provide City <br />with evidence of each payment of rent for the Relocation Site, and the date on <br />which that rent commenced. Owner shall receive a credit towards the Final <br />Payment for any rent paid to the City for the Subject Property which overlaps <br />Owner's rental payments for the Relocation Site. <br />C) Utilities. For such time as Owner owes rent to the City for Owner's occupancy of <br />the Subject Property, Owner shall pay all costs incurred by it for services <br />provided to the Subject Property, including but not limited to natural gas, <br />electricity, telephone, sewer, water, cable television and garbage removal <br />(collectively "Utilities'). Owner shall receive a credit towards the Final Payment <br />for any payments made by Owner for Utilities after Owner's obligation to pay <br />rent for the Subject Property has ended (as to which Owner has provided proof of <br />payment to City). <br />d) Taxes. For such time as Owner owes rent to the City for Owner's occupancy of <br />• the Subject Property, Owner shall be liable for taxes payable with respect to the <br />Subject Property as provided in the Lease. <br />C: <br />
