PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> STATE OF MINNESOTA <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A SITE PLAN AND PLANNED <br /> RESIDENTIAL DEVELOPMENT AMENDMENT. <br /> WHEREAS, an application for an amendment to an existing Planned Residential <br /> Development and Site Plan was made by Brightondale Assisted Living to allow <br /> construction of a 1,200 SF dining room expansion and other related improvements to the <br /> assisted living facility at 2700 Rice Creek Road, and <br /> WHEREAS, the procedural history of the application is as follows: <br /> 1. Applications for a Planned Residential Development Amendment and Site Plan were <br /> made on May 1, 2009. <br /> 2. Brightondale Assisted Living held a neighborhood meeting on May 5, 2009. <br /> 3. The Planning Commission, pursuant to published and mailed notices, held a public <br /> hearing on May 19, 2009 and all persons present were given an opportunity to be <br /> heard. <br /> 4. The Planning Commission recommended to the City Council the request is approved, <br /> subject to conditions. <br /> WHEREAS, the Planning Commission makes the following Findings of Fact with <br /> respect to the Planned Residential Development Amendment (RD2009-002) and Site <br /> Plan(LP2009-002): <br /> 1. The property is located at 2700 Rice Creek Road. <br /> 2. The property is zoned R-2, Two Family Residential. <br /> 3. The property is guided in the New Brighton Comprehensive Plan for Medium Density <br /> Residential. <br /> 4. The property previously received Planned Residential Development approvals in <br /> 1979, 1985, and 2000 documented per Resolution#'s 2226, 85-131A, and 00-088. <br /> 5. The proposed improvements include a 1,200 SF dining room expansion, construction <br /> of an expansion to the infiltration area, reconstruction of a patio area to the direct <br /> north, removal/relocation/replacement of various mechanical equipment, and various <br /> landscaping removals and additions. <br /> 6. The net increase in hard-surface for the proposed improvements is 300 SF. <br /> 7. The PRD standards of Section 7-060 were considered and it was determined the <br /> proposed expansion remains in compliance with these standards and the intent of the <br /> original PRD. <br /> 8. The Planning Commission considered the review criteria of Section 7-070 and based <br /> upon the PRD and Site Plan analysis it was determined these criteria were met due to <br /> the following: <br /> a. The proposed density on site is not proposed to increase. <br /> b. The height of the proposed addition is one story. <br />
