RESOLUTION NO. <br />09-036 <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />MAKING FINDINGS OF FACT AND APPROVAL OF A SITE PLAN AND PLANNED <br />DEVELOPMENT AMENDMENT. <br />WHEREAS, an application for an amendment to an existing Planned Residential <br />relopment and Site Plan was made by Brightondale Assisted Living to allow <br />struction of a 1,200 SF dining room expansion and other related improvements to the <br />sted living facility at 2700 Rice Creek Road, and <br />WHEREAS, the procedural history of the application is as follows: <br />Applications for a Planned Residential Development Amendment and Site Plan were <br />made on May 1, 2009. <br />Brightondale Assisted Living held a neighborhood meeting on May 5, 2009. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 19, 2009 and all persons present were given an opportunity to be <br />heard. <br />The Planning Commission recommended to the City Council the request is approved, <br />subject to conditions. <br />The City Council considered the request on May 26, 2009. <br />WHEREAS, the Planning Commission and City Council make the following Findings <br />Fact with respect to the Planned Residential Development Amendment (RD2009-002) <br />d Site Plan (LP2009-002): <br />The property is located at 2700 Rice Creek Road. <br />The property is zoned R-2, Two Family Residential. <br />The property is guided in the New Brighton Comprehensive Plan for Medium Density <br />Residential. <br />The property previously received Planned Residential Development approvals in <br />1979, 1985, and 2000 documented per Resolution #'s 2226, 85-131A, and 00-088. <br />The proposed improvements include a 1,200 SF dining room expansion, construction <br />of an expansion to the infiltration area, reconstruction of a patio area to the direct <br />north, removal/relocation/replacement of various mechanical equipment, and various <br />landscaping removals and additions. <br />The net increase in hard -surface for the proposed improvements is 300 SF. <br />The PRD standards of Section 7-060 were considered and it was determined the <br />proposed expansion remains in compliance with these standards and the intent of the <br />original PRD. <br />The Planning Commission and City Council considered the review criteria of Section <br />7-070 and based upon the PRD and Site Plan analysis it was determined these criteria <br />were met due to the following: <br />
