<br />.~ <br /> <br />J <br /> <br />6- <br /> <br />RESOLUTION No. 02-009 <br />STATE OF MINNESOTA <br />COlJNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDATION OF APPROVAL OF <br />SP 01-014. <br /> <br />WHEREAS, an application for a special use permit has been made by Mr. Bob Smith to <br />allow an automotive service use located at 2350 Palmer Drive. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />]. An application for a special use permit was filed with the City of New <br />Brighton on November 16,2001. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on December 18, 200 I, and all persons present at the hearing <br />were given an opportunity to be heard. <br />3. The Planning Commission unanimously recommended approval ofthe Special <br />Use Permit at a Public Hearing with conditions. <br />4. The City Council considered the application at the regular meeting of January <br />8, 2002. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings <br />of Fact in respect to SP 01-014: <br /> <br />I. The subject site is zoned B-3, General Business. <br /> <br />2. The applicant is proposing to provide automotive service, which is allowed <br />with a Special Use Permit regulated by Chapter 8 of the Zoning Code. <br /> <br />3. The applicant is proposing to create entrance and exit doors on the east and <br />west ends of the building. <br /> <br />4. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use <br />will not be detrimental to or endanger the public health, safety, morals, <br />comfort of general public. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinityfor the purposes already <br />permitted, nor substantially diminish and impair property values within <br />the neighborhood. <br /> <br />c.
