Belair Excavating Noise and Land Use Issues — Council directed staff to work on a code <br />amendment that would create a conditional or special use permit process that would allow Belair <br />Excavating's operation to continue to exist with conditions. It is expected that the conditions in <br />such a permit process will address the complaints previously filed against the property such as <br />tailgate banging and dust. <br />2. Northwest Refinery Site — Staff meet recently with MPCA staff about delisting the N WRF <br />site, MPCA would like to enter into a clean up agreement with Ashland Refinery (the responsible <br />party for the pollution) effectively taking the NWRF site out of the superfund site and giving it a <br />delisted status. The agreement would set clear parameters of clean up along with establishing <br />timelines for the cleanup. The City's legal counsel recommended that the City become a third <br />party to the agreement. The Council agreed and directed staff to send a letter to the MPCA <br />stating the City Council's wishes. <br />Dean R.
