AGREEMENT BETWEEN THE CITY OF NEW BRIGHTON <br />AND RAMSEY COUNTY FOR CONSTRUCTION AND MAINTENANCE <br />OF TRAILS IN LONG LAKE REGIONAL PARK <br />This Agreement is made between Ramsey County, Minnesota, a political subdivision <br />of the State of Minnesota, on behalf of the Parks and Recreation Department, 2015 North <br />Van Dyke Street, Maplewood, Minnesota 55109 ("County") and the City of New Brighton, a <br />municipal corporation of the State of Minnesota, 803 Old Highway 8, N.W., New Brighton, <br />Minnesota 55112 ("City"). <br />WHEREAS, The County owns and operates Long Lake Regional Park located in the <br />City of New Brighton; and <br />WHEREAS, The City desires to develop a trail connection into Long Lake Regional <br />Park, a portion of such trail which will be constructed on County property, as illustrated on <br />Exhibit A; and <br />WHEREAS, The Ramsey County Parks and Recreation Department has worked <br />cooperatively with the City to determine the design and alignment of the trail which will <br />enhance recreational opportunities for all park users; and <br />WHEREAS, The City will be responsible for all costs associated with the construction <br />and ongoing maintenance of the trail; and <br />WHEREAS, The City and County wish to memorialize the City's authority and <br />obligations for construction, use, ongoing maintenance, replacement and reconstruction of <br />the trail. <br />NOW, THEREFORE, pursuant to the statutory authority granted to each party and in <br />consideration of the mutual covenants and promises made herein, the parties agree as <br />follows: <br />SECTION 1 <br />TERMS <br />1. The City shall be responsible for preparing plans and specifications and <br />administering the project. Plans and specifications shall be subject to approval by <br />the Ramsey County Parks and Recreation Department prior to the start of any <br />construction. <br />2. The County grants the City access to property within Long Lake Regional Park for <br />the purposes of constructing and maintaining a 10 -foot wide bituminous trail <br />including signage, restoration and landscaping as illustrated on Exhibit A.
