CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A GRANT AGREEMENT <br />WITH THE MINNESOTA DEPAR'T'MENT OF EMPLOYMENT AND ECONOMIC <br />DEVELOPMENT <br />AND AUTHORIZING ITS EXECUTION <br />WHEREAS, the City of New Brighton, Minnesota (the "City") owns and operates a storm <br />water utility and storm water system, pursuant to the authority of Minnesota Statutes, Chapter 444; <br />and <br />WHEREAS, the City has adopted a redevelopment program for Redevelopment District No. <br />I in the City, pursuant to the authority of Minnesota Statutes, Sections 469.124 to 469.134; and <br />WHEREAS, the project area for Redevelopment District No. 1 includes an area of the City <br />known and referred to as the "Northwest Quadrant"; and <br />WHEREAS, the legislature has authorized the Minnesota Department of Employment and <br />Economic Development ("DEED") to make a grant to the City to assist in making public <br />improvements to the sanitary sewer and storm water systems in the Norwest Quadrant; and <br />WHEREAS, DEED and City staff have presented to the City Council for its consideration a <br />proposed grant agreement entitled "General Obligation Bond Proceeds, Grant Agreement - <br />Construction Grant for the Northwest Quadrant Redevelopment No. 2 Project, SPAP-09-0003-P- <br />FY 10 (the "Grant Agreement"); and <br />WHEREAS, the City Council has determined that the execution of the Grant Agreement <br />and the construction of the public improvements to be financed thereby are consistent with the <br />purposes of Redevelopment District No. 1 and the City's storm water utility system. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />NEW BRIGHTON, MINNESOTA: <br />1. The Grant Agreement is hereby approved. <br />2. The Mayor and City Manager are authorized and directed to execute the Grant <br />Agreement on behalf of the City of New Brighton, together with such changes in form as do not <br />substantially affect the rights of the City and as approved by the City Manager and the City <br />Attorney. <br />358512YI CLL NE136-229 <br />
